Agreement to Terms

By downloading, installing, or using Air ("the Software"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Software.

Description of Service

Air is a macOS application that provides AI-powered assistance through voice commands. Air can interact with native macOS applications to perform actions on your behalf, including but not limited to file management, messaging, calendar events, and note-taking.

License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the Software on macOS devices that you own or control, for your personal or internal business purposes.

Restrictions

You agree not to:

  • Copy, modify, or distribute the Software
  • Reverse engineer, decompile, or disassemble the Software
  • Rent, lease, lend, sell, or sublicense the Software
  • Use the Software to violate any applicable laws or regulations
  • Use the Software to harm, harass, or infringe on the rights of others
  • Attempt to circumvent any security features of the Software
  • Use the Software to send spam or malicious content

User Responsibilities

You are responsible for all actions performed by Air on your behalf. You should review Air's activity log regularly and ensure that the actions taken align with your intentions. Air requires certain macOS permissions to function; you are responsible for granting only the permissions you are comfortable with.

Account Terms

If you create an account:

  • You must provide accurate and complete information
  • You are responsible for maintaining the security of your account
  • You must notify us immediately of any unauthorized access
  • You may not use another person's account without permission

Intellectual Property

The Software and all related intellectual property rights are owned by Air and its licensors. These Terms do not grant you any rights to our trademarks, logos, or brand features. Any feedback you provide may be used by us without obligation to you.

Disclaimer of Warranties

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE SOFTWARE.

Indemnification

You agree to indemnify and hold harmless Air and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising out of your use of the Software or violation of these Terms.

Termination

We may terminate or suspend your access to the Software at any time, with or without cause or notice. Upon termination, your license to use the Software will immediately cease. You may terminate by uninstalling the Software and deleting your account.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through the Software. Your continued use after changes constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising from these Terms shall be resolved in the courts of Delaware.
